These Terms of Service (“Terms”) govern your access to and use of the XStable platform, including any websites, applications, interfaces, smart contracts, APIs, or related services provided by or associated with XStable (“XStable”, “we”, “us”, or “our”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
By accessing or using any part of the Services, you represent that you have read, understood, and agreed to be bound by these Terms. XStable reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon publication. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
XStable provides a non-custodial technology platform that enables users to interact with blockchain-based protocols, smart contracts, and digital asset markets. The Services may include trading interfaces, protocol access tools, analytics, APIs, and related functionality.
XStable does not custody user funds, control user wallets, or act as a broker, dealer, exchange, or financial intermediary unless expressly stated otherwise.
The Services are provided on an “as is” and “as available” basis, and XStable does not guarantee uninterrupted or error-free operation.
You represent and warrant that you are legally permitted to access and use the Services under the laws applicable to you, and that doing so does not violate any applicable laws, regulations, or sanctions regimes.
You are solely responsible for ensuring the security of your wallet, private keys, credentials, and any actions taken through your wallet. XStable does not have access to your private keys and cannot recover digital assets in the event of loss.
You agree not to use the Services to engage in any unlawful, fraudulent, or abusive activity. Prohibited activities include, but are not limited to:
XStable reserves the right to restrict or terminate access to the Services if it reasonably believes that you have violated these Terms or applicable law.
You acknowledge and agree that interacting with blockchain technology and digital assets involves significant risk, including but not limited to: price volatility, smart contract vulnerabilities, protocol failures, oracle failures, network congestion, forks, regulatory uncertainty, and total loss of funds.
You expressly acknowledge that you use the Services at your own risk and that XStable does not provide investment, financial, legal, or tax advice.
To the maximum extent permitted by law, XStable disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
XStable does not warrant that the Services will meet your requirements or that any results obtained through the Services will be reliable or accurate.
The platform reserves the right to unilaterally determine and cancel profits from trades involving "scalping" or "latency arbitrage." In the event of oracle failures or abnormal pricing caused by extreme market conditions, the platform reserves the right to perform a rollback. If a user's account balance becomes negative, the platform reserves the right to deduct the amount from the user's airdropped tokens or linked/associated accounts.
To the fullest extent permitted by applicable law, XStable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of digital assets, arising out of or related to your use of or inability to use the Services, even if XStable has been advised of the possibility of such damages.
In no event shall XStable’s aggregate liability exceed the amount paid by you, if any, for access to the Services.
All intellectual property rights in the Services, including software, text, graphics, trademarks, and logos, are owned by or licensed to XStable. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for their intended purpose.
XStable may suspend or terminate your access to the Services at any time, with or without notice, if it believes you have violated these Terms or pose a legal or security risk.
Upon termination, your right to use the Services will immediately cease, but provisions that by their nature should survive termination shall remain in effect.
Where a user participates in any promotional campaigns, including but not limited to trial cards, fee discounts, referral programs, or airdrops, XStable reserves the right to suspend, restrict, or terminate the relevant promotional benefits if the user engages in abnormal trading activities or violates platform rules (including but not limited to hedging arbitrage, wash trading, abnormal self-matching, exploitation of system vulnerabilities, or other improper conduct).
XStable further reserves the right to recover any improperly obtained gains arising from such activities. The platform may, to the extent permitted by applicable laws and regulations, interpret, modify, or adjust the rules of such promotions, with any changes taking effect upon announcement or on-page disclosure.
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction determined by XStable, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the designated courts or arbitration forum of that jurisdiction.
These Terms constitute the entire agreement between you and XStable regarding the Services and supersede all prior agreements or understandings.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
XStable’s failure to enforce any right or provision shall not constitute a waiver of such right or provision.
